Since taking office, President Trump has cast doubt and uncertainty on many of former President Biden’s executive orders and other documents signed via autopen. At this point, the current administration is concerned that the former President’s staff may have illegally used the autopen to approve certain orders or fund specific projects. It’s unclear whether Biden was aware of all the orders that were allegedly signed with the autopen.
During the annual Washington Thanksgiving celebration, the current President Trump joked that the Thanksgiving turkey’s Biden pardons were now “null and void” because of Biden’s use of the autopen to pardon them.
This joke could be a reflection of President Trump’s true intention to terminate documents and orders that he believes were signed with an autopen and without proper authorization.
According to President Trump’s recent Truth Social post, the former President Biden administration may have signed up to 92% of documents and orders with the use of the autopen. The post goes on to state that the use of autopen is not allowed unless approval is specifically granted by the President of the United States. On the same post, Trump reportedly threatened Biden with perjury charges if he attempts to falsely claim that he agreed to the use of the autopen on so many occasions.
The President is convinced that the autopen was used so frequently that he even replaced President Biden’s official portrait in the White House “Walk of Fame” with a photograph of an autopen instead.
While it’s true that the use of autopen signatures should be as limited as possible, it’s unclear whether the President will actually attempt to nullify past orders.
Presidents have been using autopens since at least the 1940s during Harry Truman’s administration, and it would be extremely difficult to prove whether President Biden knowingly approved and authorized the autopen use on various pieces of legislation.
While it’s nice to imagine that most people operate in society lawfully, it’s far more realistic to consider that some orders may not be entirely legal, and some actions taken by people in power are driven by corruption.
