Attorney Judd says that the certification process in Griffith’s case was improper, which should lead to a successful appeal. Previously, Family Court Judge Linda Marquis certified Judd’s client, Griffith, as an adult.

Marquis made this judgment and decision before recusing herself from Griffith’s co-defendant’s case. Marquis was recused because of a glaring conflict of interest with the attorneys who were representing the assault victim.

Judd argues that this conflict of interest may also have influenced Marquis’s decision to certify Griffith as an adult, rather than the facts of the case, which should be the basis for certification. That being said, it’s Judd’s recommendation that Griffith’s case get sent back through the juvenile system for a secondary review by a new judge. This review would give Judd’s client, Griffith, a fair shot at being tried as a juvenile rather than an adult.

This distinction is very important because juvenile courts typically prioritize confidentiality and rehabilitation, whereas adult courts primarily focus on punishment. As an adult, crimes are public record, but as a juvenile, records can be sealed, and cases are typically private.

The judge has ordered Griffith to return to court by March 24. The hearing will not be delayed despite the arguments surrounding the juvenile certification appeal. It’s important to note that Griffith’s co-defendant, 15-year-old Kim, was still certified to be tried as an adult as well. Both boys are accused of recording a sexual assault on their phones while on a field trip with their peers. They’re additionally accused of sharing that video with other children at school.
